Re: Complaint against Judge D J Alissandratos and request for copy of disciplinary counsel’s recommendation

Dear Judge Riley,

I was troubled by the Court of Judiciary’s dismissal of our complaints against Judge D. J. Alissandratos. In his letter of October 18, 2004, Judge J. Steven Stafford gave a 17 point explanation for the dismissal; however, our complaint had 28 charges. Judge Stafford ignored a lot of the key charges. For instance, Judge Stafford failed to even mention Charge No. 9, “Mr. Alissandratos had ex parte communications with Larry Parrish on Feb 7, 2002, which resulted in the issue of the Guardianship order”. This charge, unlike Charge No 10 (which is about the No Contact order), has no conflicting testimonies. During the trial, Parrish testified the following about the Guardianship order and the No Contact order:

"So, the hearing ended on February 7th, and the court reporter has winding up and everybody was winding up and headed out of the court, and Mr. Alissandratos had stood up and started to leave the bench. And I can tell you exactly where I was standing in the chancery court, and he turned around to me and he said, draft me an order on making this Court the guardian. He didn't ask me what I thought about that or anything else. He just told me that, and he said, I want No Contact until I order otherwise. Bring me an order tomorrow. He didn't want this included in any of the other orders. I was taking instructions only."

Later, in Parrish’s response to motion to re-open proof, Parrish changed the story about the “no contact” order but he re-affirmed the ex-parte nature of the Guardianship order:

“27. All to which Counsel testified concerning the directive of Chancellor Alissandratos, in the courtroom on the morning of February 7, 2002, i.e., to draft an order appointing the Bakers guardians with full custody, occurred just as testified by Counsel; before the order appointing the Bakers was delivered to the Court, the later afternoon conference occurred during which the “no contact” directive was added to the directive earlier in the day”.

It is 100% clear that the Guardianship order was issued ex-parte on the morning of Feb 7, 2002 right after other parties left the courtroom. This Guardianship order could not have anything to do with the passport event that happened around of Feb 7, 2002.

I am deeply disturbed by the fact that the Court of Judiciary chose to ignore charge No 9. I can also list other charges that were conveniently ignored by the Court.

As far as I know, Judge D. J. Alissandratos and his lawyer have had access to your recommendation to the investigative panel. I believe that I have the right to obtain a copy of your recommendation and report. I request you to send me a copy of your recommendation on the complaint against judge Alissandratos.

In our conversation, you expressed understanding towards me as a father who cares for his children, we thank you deeply for that understanding. To get our daughter back, we must fight against injustice, by all legal means. Therefore, we will continue to purse the case against D. J. Alissandratos.
